Article 1: General
These General Conditions of Sale govern the contractual relations between the Buyer and the Seller TRANNEX SA in the context of products sold on the website www.silac.eu.
The Buyer hereby confirms he has full knowledge of these General Conditions of Sale and that he expressly accepts these at the time of placing his order. Confirmation of the order signifies acceptance of these General Conditions of Sale.
TRANNEX SA reserves the right to amend or modify these conditions of sale in whole or in part at any time. When the Buyer places an order on the website, the General Conditions of Sale are those in force on the website on the date of the order confirmation.
Any natural or legal person having legal capacity and residing in a member state of the European Union may place an order on the www.silac.eu website.
Article 2: Orders
To place an order the Buyer shall provide all the information required to identify him by completing the form that is made available. TRANNEX SA cannot be held liable for mistakes made by the Buyer in the wording of the recipient’s details (delivery address etc.) or delivery delays or if such mistakes render it impossible to deliver ordered goods.
By confirming the order, the Buyer accepts the description of the goods and the price, and confirms and acknowledges that he accepts the General Conditions of Sale.
All orders will then be confirmed to the Buyer by confirmation of receipt sent by e-mail confirming the details entered, the name of the product, the quantity ordered, the price including VAT, the shipping costs, the payment method and the delivery.
Article 3: Price
The prices of our products are stated in euros, including VAT (21%), excluding shipping costs, which will be stated at the time of placing the order and before final confirmation.
The packing and shipping charges for the order are paid by the Buyer as stated under the heading ‘shipping costs’ at the time of placing the order and before confirmation.
TRANNEX SA reserves the right to modify its prices at any time without warning, in particular because of changes to supplier prices.
The applicable price will be that in effect at the time the order is registered, subject to availability on that day.
Article 4: Payment
All orders are payable in euros via a secure website.
Transactions will be accepted via Visa, MasterCard and Maestro cards. Bancontact/Mistercash transactions are also possible in Belgium.
Transactions made on TRANNEX SA are secured by the Ogone (www.ogone.com) payment system.
All information exchanged in order to process payments is encrypted using the SSL protocol. Such information cannot be detected, intercepted or used by third parties. These payments are not stored in our IT systems.
Ogone is a technical service provider and does not deal with disputes arising from orders. These must be settled directly with TRANNEX SA or your bank.

The body responsible for securing the payment mentioned at the time of the transaction is liable to change without warning.
Orders must be paid at the time of ordering and will only be sent to the Buyer when the entire price including VAT and shipping costs have been paid.
TRANNEX SA reserves the right to refuse any order placed by a Buyer who has not paid or only partially paid a previous order. Similarly, any order or delivery may be cancelled if the financial organisations refuse to authorise your payment.
Article 5: Products
The goods offered for sale by TRANNEX SA and the prices are valid as shown on our website, subject to stock availability.
The descriptions and photographs associated with products are provided for information purposes and no technical or typographical error shall give rise to a complaint on the part of the Buyer and TRANNEX SA rejects any responsibility for such errors.
If goods are out of stock, the Buyer will be notified of any extended delivery time. In that case the Buyer will be able to cancel his order and to request a full refund, or to order one or other products instead of the unavailable product. If the Buyer does not reply within 7 days following the e-mail notifying the extension of the delivery time, the Buyer will be assumed to accept the order and the new delivery time.
TRANNEX SA cannot be held responsible if the delivery time is exceeded or if it is impossible to deliver goods due to a situation of force majeure. The following are deemed to be situations of force majeure: all events and circumstances that are beyond the control of the parties, such as strikes, fires, floods, theft and all exceptional circumstances that delay or render the delivery impossible.
Circumstances that interfere with the execution of the order shall result in full or partial cancellation of the order with refund of the cancelled order after informing the Buyer.
Article 6: Delivery
Products purchased on the www.silac.eu website may be delivered in Belgium and all countries in the European Union.
Shipping costs:

The products will be sent by Bpost or a carrier to the delivery address mentioned by the Buyer with his order. Goods will be delivered within a reasonable time (generally 3-8 working days) provided that the Buyer has confirmed the order and full payment has been made.
Any damage detected in connection with the transport conditions at the time of delivery or non-compliance of the delivered product in relation to the order form must be notified as soon as possible.
Any delivery problems (missing or damaged goods) must be notified to TRANNEX SA by e-mail to info@silac.eu within two working days following receipt of the products. The corresponding item must be received by TRANNEX SA within 14 days of the delivery, with a request for an exchange or refund to the following address: TRANNEX SA, Rue des Sablières 45 Unit 1, 1435 Mont-Saint-Guibert, Belgium.
Article 7: Transfer of title and risk
Ownership of the ordered items is transferred when the full price is paid, including the shipping costs and VAT. Any risks relating to delivered products will transfer to the Buyer at the time of delivery.
Article 8: Right of withdrawal
The purchaser has a right of withdrawal in accordance with statutory provisions. The Buyer has a period of 14 calendar days, starting from the day after delivery, to notify the Seller that he wishes to cancel the order, without penalty and without stating reasons.
At the end of this 14-day period, it will be assumed the delivered items comply with the order and that the Buyer has accepted them.

Goods must be returned to the following address: TRANNEX SA, Rue des Sablières 45 Unit 1, 1435 Mont-Saint-Guibert, Belgium.
The shipping costs for returning goods to TRANNEX SA are for the Buyer's expense. All returned goods must be accompanied by a copy of the original invoice.
Only goods in good condition and in their original packaging can be returned. They must be carefully packaged to prevent any damage during return shipping. The Buyer is responsible for returning goods.
Spectacles will not be taken back or exchanged if they are incomplete, damaged, dirty, if they show traces of having been used other than simply to try them out or if the original packaging is missing.
If you exercise your right of withdrawal, refunds (except for costs of shipping and return) will be made within a maximum 30 days following withdrawal, subject to compliance with the return conditions.
Article 9: Warranty and liability
Products are offered with a warranty of one month against hidden defects. Defects or damage due to incorrect use, such as oxidation, dropping or shocks, negligence and wear and tear are not covered by the warranty.
TRANNEX SA rejects liability for any damage that could result from incorrect use of its products, and any other damage resulting from a delay in the implementation of an order if this is due to force majeure or exceptional events such as strikes, natural disasters etc.
All products appearing on www.silac.eu are described as precisely as possible. Nevertheless, descriptions and photos are only provided for indicative purpose and TRANNEX SA is not liable for these. Complaints about the colour and descriptions will not be accepted.
Article 10: Purposes of processing personal data
TRANNEX SA collects personal data when you visit our website and when you order our products on line.
Any data that you transmit when ordering our products and services on line will be used to process your order and to execute your contract.
Data concerning all registered profiles will be retained to process your future orders.
The personal data we request from you are necessary to process your order. We will be unable to process your order if you do not fill in the compulsory fields.
With your authorisation, your e-mail address will be used in order to inform you about new products, services and promotions.
You can unsubscribe from such messages at any time by sending an e-mail to info@silac.eu.
We do not process or store any financial information (credit card number and expiry date) about you. Such data are directly registered on the website of our secure payments partner, which follows its own personal data protection rules.
Connection data (IP address, country, date, time and duration of the connection, pages visited etc.) will be processed for statistical purposes and to improve the website and the service we offer you.
Article 11: Intellectual property
All elements on this site (trade marks, logos, photos, texts, illustrations, descriptions etc.) as well as in newsletters sent by e-mail are protected by copyright and by intellectual property rights. Any reproduction or transmission of such elements is strictly prohibited without the prior written consent of TRANNEX SA.
Article 12: Applicable law and jurisdiction
These General Conditions of Sale are subject to Luxembourg law. In the event of disputes, Luxembourg law shall apply and the courts of the judicial district of Luxembourg shall have exclusive jurisdiction.
